Acknowledgement and acceptance of these terms of services

 

This page states the terms and conditions (the T&C) under which you may access and/or use our App for specific functionalities. There is a detailed T&C document for the entire application which you can access while registering on the app or from our website, www.doitzero.com. Please read this page carefully. If you do not accept the Terms and Conditions stated herein, you may not use ‘Plant a Tree with DIZ’ and ‘Gift a Tree’ features of the App.

Do It Zero (India) Private Limited ("Company" or "We" or "Us" or “Do It Zero™”) is the owner of this App, and all the content herein, and reserves the right to change these T&C at any time without notice to you, and upon such change, the same shall be effective immediately. You agree to review these T&C on a regular basis. By using the App, you are agreeing to be bound by the T&C as updated from time to time.

 

1. Description of the Service

Do It Zero (DIZ) provides its ‘Service’ (defined as ‘Plant a Tree with DIZ’ and ‘Gift a Tree’ functionalities available on Do It Zero’s mobile and web application) to you subject to the following Terms & Conditions ("T&C"), which may be updated by us from time to time. DIZ also offers other services that are governed by different Terms of Use, available on the website and mobile app.

2. Tree Plantation Verification and Ownership

​​DIZ through its applications facilitates users to enable planting of trees through its Tree Plantation Partner/s. Users can choose to buy trees in bulk and plant or gift trees to their loved ones. The orders are passed on to the Tree Plantation Partner/s after the payment is received. Tree Plantation Partners are solely responsible for execution of these orders and for the planting of the trees.

DIZ only issues a maximum of one certificate per tree planted and a certificate can be created only if one or more trees are planted. The certificate will be issued to the registered user for 'Plant a Tree with DIZ’ Service and the certificate will be issued to the recipient when using 'Gift a Tree' functionality. The trees will be planted within 30 days from the day of payment on the app. Once planted, the user will be notified within the app through in-app notification.  The certificates are not assignable and are not intended to constitute “securities” under the definition of the securities laws of any jurisdiction.  The App does not constitute a solicitation or offer to sell securities of any sort.

Tree Plantation Partners have assured DIZ that they plant trees in public lands only after securing written requisite permissions from the land development authorities. (For eg. Village Gram Panchayat / State Forest Department/ State Development Authority). Tree Plantation Partners have assured us that they will make their best efforts to ensure that all trees survive. However, neither the Tree Plantation Partners nor DIZ can be held responsible for trees that die through disease, flood, drought, fire, lightning and other  events beyond the control of the Tree Plantation Partners or DIZ, including for trees that are illegally felled or are destroyed by grazing.. DIZ may appoint independent auditors who will go to a representative sample of planting sites to verify on a sample basis that trees have been planted by planting partners as per instructions.

You don’t get a choice of tree species or location of plantation. However, once the tree is planted, we will provide you with the details of your tree on the app and you can track your tree from there. 

You do not own the tree that you plant and we do not arrange site visits. However, we are providing all details in the app regarding your tree, including the geolocation of the site so that you can virtually track its progress.

DIZ and its tree planting partners map every tree planted to its user through a unique Tree ID and provide the geolocation of the site where the user's tree is planted.  Please note that it is possible that the tree will be planted on private property and you may not have access to such tree, nor will you use the geolocation details for any purpose except for your own progress tracking.

You also understand and agree that DIZ cannot be held responsible for scientific accuracy or reliability of information it provides on its properties, though it makes every effort to obtain such information from sources it believes in good faith are reliable. 

 

3. Do It Zero Privacy Policy

Registration Data and certain other information about you is subject to our Privacy Policy. For more information, see our full privacy policy. You understand that through your use of the ‘Service’, you consent to the collection and use of your data (as set forth in the Privacy Policy) of this information.

 

4. User Conduct

You understand that all information, data, text, photographs, graphics, certificates, video, messages, gift messages, tags, or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that you, and not DIZ, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the app. DIZ provides your Share cards for sharing the App content on social media, any other content beyond the share cards is sole responsibility of the user and DIZ does not guarantee the accuracy, integrity or quality of such Content. Under no circumstances will DIZ be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the App.

 

5. No Refund

You understand that the ‘Services’ include real world actions where reversal would harm the environment. You understand that all sales are final. There is no refund on trees or the Service.

 

6. Modifications to the Service

DIZ reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the ‘Service’ (or any part thereof) with or without notice. You agree that DIZ shall not be liable to you or to any third party for any modification, suspension or discontinuance of the ‘Service’.

 

7. Payment related Information

We respect your privacy, and we will not share your payment information, such as credit card details, with anyone except as necessary to process payment and to comply with all applicable laws. Refer to DIZ Privacy Policy and Term of Use for more details.

 

8. No Warranty

We do not provide any warranty, express or implied, as to the growth, description, or variety of the plant you purchase through our app.

 

9. Order Rejection and Reimbursement

We reserve the right to reject your order at any time, and we are not required to provide reasons for doing so. If we reject your order, we will reimburse you for any payments already received by us.

 

10. Governing Law and Dispute Resolution

This Agreement shall be governed by the laws of India and any disputes arising here from shall be subject to the sole and exclusive jurisdiction of the courts at Hyderabad, Telangana, India.
